Maxwell charged with violation of court order

DAHLONEGA, Ga. – Deputies with the Lumpkin County Sheriff’s Office arrested Zachary Maxwell, 26, of 1143 Auraria Road in Dahlonega last week. He is charged with criminal trespass, violation of a family violence order and interference with a call for emergency services.

On Sept. 29 deputies responded to a 9-1-1 call from Tabitha Foutch who claimed Maxwell, her live-in boyfriend, broke two of her cell phones while she was attempting to call  9-1-1.

According to the arrest report, she stated that she ordered Maxwell to leave her home after she caught him texting his ex-girlfriend. She said he did leave briefly, but returned and threw her phone in the yard and her car keys into the woods across the street. When she told him she was calling the police, he smashed her phones on the ground then grabbed her TV and threatened to break it.

When she went to a neighbor’s house to call 9-1-1, she stated that she saw him take a knife and slash her tires.

Maxwell told officers when Foutch ordered him out of her residence, she threw his phone into the woods. It was at that point, he retaliated by breaking both her cell phones. He denied slitting the car tires, however, and added the tire had gone flat in the morning. But deputies noticed the tires going flat while they were there and located slits in each sidewall.

The charge for violating a family violence order stems from the fact that Maxwell was living with Foutch whose residence is less than 200 feet from 69 Major D Drive, the residence of his ex-girlfriend, Elizabeth Davenport. A recent family violence court order prohibited him from being within 100 yards of her.

Maxwell was then transported to Lumpkin County Detention Center.
